You retain ownership of any content you submit to the Platform. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content in connection with providing our Services.

User Content

You are responsible for the content you submit to the Platform. You represent and warrant that you have all necessary rights to submit such content and that it does not violate any third-party rights or applicable laws. We reserve the right to remove any content that violates these Terms.

Payment Terms

FundX is currently offered free of charge. If we introduce paid features or subscriptions in the future, we will provide advance notice and updated terms. Any paid services will be subject to the pricing and payment terms disclosed at the time of purchase.

Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that the Platform will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Platform is free of viruses or other harmful components.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUNDX AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM.

Indemnification

You agree to defend, indemnify, and hold harmless FundX and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses arising out of or relating to your violation of these Terms or your use of the Platform.

Termination

We may terminate or suspend your access to the Platform immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Platform will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in San Diego County, California.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Your continued use of the Platform after such changes constitutes acceptance of the new Terms.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
